Appeal against Rights Commissioner's Recommendation No. RP117/85.
Recommendation:
3. The Court having considered the submissions made finds that on
the basis of the information before him the Rights Commissioner
was correct in his recommendation and the Court so decides.
However taking into account further information brought before it
the Court is of the opinion that the worker was ill advised in not
resigning on medical grounds. In light of this the Court would
urge the Company to explore the possibility of restoring the
situation so as to allow the worker to benefit from terms set out
in the Trustee's letter of 20th November, 1984.

2. I refer to Labour Court hearing between the above mentioned
parties on 30th October, 1986. The Court recommends as follows:-
