Subject:
1. Claim on behalf of four locksmiths for the introduction of an
incremental service scale.
Background:
2. The claim was originally made as part of a thirteen point
26th wage round claim. After failure to resolve this particular
item, it was agreed by both parties that it could be pursued
separately.
The locksmiths are on a basic rate of pay of #172 for a 37.50 hour
week and have service varying from two to fifteen years. The
Union's claim was for #2 per week per year of service,
index-linked, up to a maximum of ten years service. The Company,
whilst not opposed to the principle of rewarding service,
considered that service-pay was more appropriate for this category
of worker and offered #2 for 5 years service. Failing to reach
agreement locally the matter was referred to the conciliation
services of the Labour Court on 6th August, 1986.
Conciliation conferences took place on the 15th September and 8th
December, 1986, at which the Union indicated that it would not be
opposed to a service-pay type arrangement, but the parties failed
to reach agreement on the level of service-pay. On 9th December,
1986, the matter was referred to the Labour Court for
investigation and recommendation. A Court hearing took place on
23rd January, 1987.
Union's arguments:
3. (i) The claim which is for an eleven point scale with
annual increases of #2.00 per week, over ten
increments, is broadly in line with a scale negotiated
in 1985 in Securicor for service engineers.
(ii) Given the specialised area of work that the locksmiths
are engaged in, it is difficult to find comparable
employments; however, in general the work is
comparable to other service engineers, the majority of
whom now have service scales.
Company's arguments:
4. (a) The practice within the Company and within the Chubb
organisation in the Republic of Ireland, is that only
non blue collar employees', have incorporated into
their remunerative package, incremental service scales.
All other categories of employees who are in receipt of
payment related to service, receive service-pay.
(b) As an alternative to its original offer the Company has
indicated to the Union its willingness to pay the
following:-
#1 after five years' service
#2 after ten years' service
#3 after fifteen years' service to a maximum of
#4 after twenty years' service.
RECOMMENDATION:
5. The Court is of the view that the Company's offer of service
pay as outlined in their submission (Page 3 and as set out above)
is reasonable and should be accepted.
The Court so recommends.
