Subject:
1. Claim, on behalf of a projectionist, for an increase in service pay
and for 2 Sundays off in 4.
Background:
2. The worker has been in the Company's employment for 17 years. He
is currently paid service pay as per the following scale:-
After 5 years' continuous service 25p
" 10 " " " 50p
" 15 " " " 75p
" 20 " " " 100p
The worker currently works a 6 day week with every Saturday off and 1
Sunday off in 5. The Union is claiming that service pay be increased
to #2 and that the worker should have 2 Sundays off in 4. The Company
rejected these claims. As no agreement could be reached locally the
Union sought to have the matter referred to the conciliation service of
the Labour Court. As the Company was not agreeable to this course the
Union referred the matter to the Labour Court for investigation and
recommendation under Section 20(1) of the Industrial Relations Act,
1969. A Court hearing took place in Galway on 29th October, 1986.
Prior to the hearing the Union undertook to accept the recommendation
of the Court.
Union's arguments:
3. (i) The current rate of service pay is very low and should be
increased to #2.
(ii) Prior to 1978 the worker had 2 Sundays off in 4. This was
arbitrarily changed by the Company.
Company's arguments:
4. (a) The current rate of service pay is in line with that paid in
all are as in Dublin and most of the country.
(b) The current practice in relation to Sundays off within the
industry is that "all employees will receive 6 Sundays off
in a 12 month period."
RECOMMENDATION:

per week with effect from 1st January, 1986, and increased to #1 per
week after 20 years service. The Court does not recommend concession
of the other claim.
