claimants, recommends that management should recognise the Union's
right to negotiate on behalf of its members in the employment.

MARINE PORT AND GENERAL WORKERS' UNION
Subject:
1. Union recognition.
Background:
2. The Club employs a total of approximately 20 workers eight of
whom have joined the Marine Port and General Workers Union. The
remaining workers are not members of any trade union. The Union,
in July/August, 1986, sought to meet with the Club Manager to
discuss the conditions of employment of the eight workers.
Management, however, refused to recognise the Union. The Union
referred the matter, on 8th October, 1986, to the conciliation
service of the Labour Court. Management, on 9th December, 1986,
indicated that it would not attend a conciliation conference. The
Union, on 3rd April, 1987, referred the matter to a full hearing
of the Labour Court, under Section 20(1) of the Industrial
Relations Act, 1969. The hearing took place on 21st May, 1987.
Prior to the hearing the Union agreed to be bound by the Court's
recommendation. The Club declined to attend the hearing but in a
letter of the 8th June Management expressed the view that the
Union is unrepresentative of the general staff.
Union's argument:
3. The Union seeks recognition by the Club as
representing the interests of eight members who are
employed by it.
RECOMMENDATION:
4. The Court, having considered the submissions made by the
