Recommendation:
5. The Court, having carefully considered the submissions made by
the parties, recommends a 26th round pay agreement as follows:-
(i) Pay pause until 30th June, 1987,
(ii) 2% increase in basic pay with effect from 1st July,
1987,
(iii) further 2% increase in basic pay with effect from 1st
January, 1988,
(iv) the Agreement to terminate on 30th June, 1988.

Subject:
1. Claim, by the Union on behalf of approximately 10 painters and
mechanics, for an increase under the 26th wage round.
Background:
2. The Company is engaged in the hire of pleasure boats and is
based at Carrick-on-Shannon and Banagher. Following the
termination of the 25th wage round the the Union lodged a claim
for the application of the Society for the Irish Motor Industry's
rate for the mechanics and the application of the Construction
Industry's craft rate for the painters and carpenters. The
Company pointed out that the work was not comparable to either the
motor industry or the construction industry and that there had
never been comparisons made with these industries before. The
Company further indicated that it had been losing money for a
number of years and that bookings for the year had been poor. For
this reason the Company sought a pay pause for 1987. On 9th
April, 1987, the dispute was referred to the conciliation service
of the Labour Court. As no agreement was reached at a
conciliation conference held on 2nd June, 1987, (the earliest date
suitable to the parties), the issue was referred on 27th July,
1987, to the Labour Court for investigation and recommendation. A
Court hearing took place on 22nd September, 1987, in Longford.
Union's arguments:
3. (a) During the course of discussions on the 25th wage
round, it was agreed by both parties that a review of
wage rates would take place in mid-July, 1986. This
review did not take place.
(b) Having regard to the skills of the workers and the
duties they perform, their rate of pay is seriously out
of line with those in the nearest comparable type of
work. Indeed, a direct comparison to other operators
on the Shannon shows that the Company's staff are being
paid considerably less (details provided to the Court).
Company's arguments:
4. (i) The Company has been in a loss making situation for a
number of years. The cumulative booking level is the
lowest since 1978. Whilst there is some hope for 1988,
these hopes have yet to be realised. In the meantime,
the Company believes that a pay pause is required to
see it through the present difficulties.
(ii) The workers receive a composite wage packet, comprising
basic pay and allowances. They also receive other
benefits including gratuities, the use of cruisers free
of charge and the food left on the cruisers by clients,
(details provided to the Court).
RECOMMENDATION:
5. The Court, having carefully considered the submissions made by
the parties, recommends a 26th round pay agreement as follows:-
(i) Pay pause until 30th June, 1987,
(ii) 2% increase in basic pay with effect from 1st July,
1987,
(iii) further 2% increase in basic pay with effect from 1st
January, 1988,
(iv) the Agreement to terminate on 30th June, 1988.
