Dispute concerning the contracting out of cleaning duties.
Recommendation:
3. The dispute before the Court arose from a proposal by the
Southern Health Board to introduce contract cleaners for some work
in St. Stephen's Hospital following the transfer of a number of
patients from Our Lady's Hospital.
The Court notes that this proposal will not result in any
reduction in the numbers presently employed and will not affect,
except in a minor way, the day to day work of existing employees.
In view of the budgetary requirements of the Board and the present
restrictions with regard to recruitment generally, and in
particular, with regard to the terms of the voluntary redundancy
package on offer to health authority employees the Court
recommends that in this particular instance the Union accept the
Board's proposals. The Court further wishes to state that it does
not consider this proposal to be contrary to the local agreement
on transfers or the 1980 Agreement between the Union and the Local
Government Staff Negotiations Board. With regard to the claim
that it is contrary to the Programme for National Recovery the
Court refers to LCR11816 where the Court stated that "the Court
does not find the issue of "contracting out" of itself covered in
the terms of the Programme."

2. The Court investigated the above mentioned dispute on the 24th
August, 1988. The following is the Court's recommendation.
RECOMMENDATION:
