Recommendation:
3. The Court considers that the compulsory transfer of the
claimant to the North Wall was contrary to the spirit and intent
of existing agreements and understandings and the Court therefore
recommends that he be re-instated in his former job in Tallaght if
he so wishes. Alternatively he should be offered compensation of
#1,000 to accept the transfer.
The Court does not recommend concession of the claim for the
retention of the Personal Product Advertising Store.

SUBJECT:
1. (a) Employee's right to transfer under the 1984 Agreement.
(b) Rentention of Personal Product Advertising Store in
Tallaght.
BACKGROUND:
2. Following a Labour Court investigation into this dispute on
the 21st January, 1988, the Court recommends as follows:-
RECOMMENDATION:
3. The Court considers that the compulsory transfer of the
claimant to the North Wall was contrary to the spirit and intent
of existing agreements and understandings and the Court therefore
recommends that he be re-instated in his former job in Tallaght if
he so wishes. Alternatively he should be offered compensation of
#1,000 to accept the transfer.
The Court does not recommend concession of the claim for the
retention of the Personal Product Advertising Store.
