Claim by the Company concerning:- (a) Shift Premiums, (b) Longer Working Week, (c) Compensation for loss of earnings.
Recommendation:
3. Having considered the submissions made by the parties and
bearing in mind the particular difficulties at present facing the
Company the Court recommends as follows on the various issues
before it:
(a) Shift premium
The Court recommends that the Company's offer of T 1/6 be
accepted.
(b) Consolidation of Shift Premium with basic rate for overtime
calculation.
The Court does not recommend concession of this claim.
(c) Consolidation of Shift Premium with basic rate for bonus
calculation.
The Court does not recommend concession of this claim.
(d) Buy out of Rate Differentials
The Court is of the opinion that the proposals made by the
I.R.O. on 9th May are reasonable and should be accepted.
(e) Introduction of 40 hour week
The Court is not satisfied that introduction of 40 hour week
is necessary in respect of all clerical QA and Laboratory
Staff. It recommends that QA staff whose attendance is
necessary for production purposes revert to 40 hours per week,
and for so doing should be paid and annual supplement of £700
to be treated for all purposes as basic salary. Other staff
whose attendance for a 40 hour week is similarly regarded as
essential by the Company to be similarly treated. All other
clerical and laboratory staff should co-operate to arrange
their hours of cover to ensure that the Company's requirements
are met within the present 35 hour work week. The Court
recommends that these changes be made without any adjustment
in rates.
The above recommendation is made in the light of the urgent
necessity to co-operate in overcoming the Company's present
difficulties and the Court further recommends that such
amended conditions of work which arise from this
recommendation be reviewed after two years in the light of
circumstances then prevailing.
