Recommendation:
6. Having regard to the submission made by the Union and
correspondence subsequent to the hearing with the Company the
Court recommends that the Company pay to the workers made
redundant 2 weeks' pay per year of service in addition to
statutory entitlement.

SUBJECT:
1. Claim on behalf of 116 workers for enhanced redundancy
payments.
BACKGROUND:
2. Following months of speculation the workers were informed in
November, 1988 that the Company was being bought by Hal-Al and
that Hal-Al would be insisting on a fresh start when it will
take-over the plant at the end of January, 1989.
3. Subsequent to this meeting a further meeting took place
between Horgan Meats Limited and the Union to discuss redundancy
terms. The Union claimed 4 weeks' pay per year of service plus
statutory entitlements. The Company offered to pay statutory
entitlements and the matter was then referred to the conciliation
service of the Labour Court on 1st December, 1988. A conciliation
conference was held on 8th December, 1988. As no agreement was
possible the Union requested a referral to the Labour Court for
investigation and recommendation. However the Company were not
agreeable to the referral and the Union then referred the case to
the Court under Section 20 of the Industrial Relations Act, 1969.
The workers agreed to be bound by the Court's recommendation. A
Court hearing was held on the 20th December, 1988.
