Claim by the Union concerning manning and annual leave on the M. V. Oleander.
Recommendation:
3. Having considered the submissions from both parties and the
terms of the agreements which are the subject of this dispute the
Court considers that as there is no reference to temporary/new
entrants in the 1987 Agreement, the Union's view that Clause 1 of
that agreement applies to crewing of the M. V. Oleander is
correct. The Court accordingly recommends concession of the
Union's claim. The Court is concerned at the obvious differences
between the parties as to the relevant status of various
agreements in existence and therefore further recommends that the
parties enter into negotiations immediately with a view to
agreeing terms of a new comprehensive agreement which would
incorporate the terms of existing agreements and deal with such
matters as temporary and new entrants.

2. Further to the Court's investigation of the above dispute on
23rd May, 1989, the Court recommends as follows:-
