SUBJECT:
1. Appeal against a Rights Commissioner's Recommendation
concerning monies owed and alleged unfair dismissal.
BACKGROUND:
2. On 31st July, 1989 the worker referred the matter to the
Rights Commissioner service for investigation and recommendation.
A Rights Commissioner investigated the dispute on 25th September,
1989 and issued the following recommendation -
"I recommend that Thermo Dri offers and the worker accepts the
sum of #100 in final settlement of this dispute."
(The worker was referred to by name in the recommendation).
3. In January, 1990 the worker appealed the Rights Commissioner's
recommendation to the Labour Court under Section 13(9) of the
Industrial Relations Act, 1969. The Court heard the appeal on 2nd
February,1990.
DECISION:
4. The Court, having considered the submissions made and taking
account of the costs incurred to the employee concerned is of the
opinion that the sum recommended by the Rights Commissioner should
be increased to #300.
The Court so decides.
