CD90554 RECOMMENDATION NO. LCR13040
INDUSTRIAL RELATIONS ACTS, 1946 TO 1976
SECTION 67
PARTIES: KILKENNY TEXTILE MILLS B.V.
(REPRESENTED BY THE FEDERATION OF IRISH EMPLOYERS)
AND
SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION
SUBJECT:
1. Dispute concerning the implementation of a bonus scheme and
basic/additional payments.
BACKGROUND:
2. The Court investigated the above dispute at its Offices in Tom
Johnson House, Haddington Road, Dublin 4, on 5th October, 1990.
RECOMMENDATION:
3. The Court is of the view that the Company/Union Agreement
must be upheld and accordingly recommends that the existing bonus
scheme continue in operation to 31st January, 1991.
The Court recognises, following the introduction of new machinery
which involved considerable capital investment, that a new bonus
scheme will have to be introduced subsequent to 31st January,
1991.
The Court therefore recommends that the parties commence
negotiations immediately on the introduction of a new scheme with
the help, if necessary, of a third party. In this regard the
Court considers an objective assessment of the work load involved
would assist the parties. The Court is satisfied that the bonus
scheme should continue to be based on the H.E.K. System.
The Court also recommends that within the context of the above
negotiations the Union's claim for regrading and the Company's
response should be further addressed.
