Labour Court Database __________________________________________________________________________________ File Number: CD91362 Case Number: LCR13349 Section / Act: S26(1) Parties: COW AND GATE WEXFORD LIMITED - and - ELECTRICAL TRADES UNION |
Dispute concerning alleged unfair dismissal.
Recommendation:
3. Having considered the submissions made the Court does not
consider that sufficient evidence has been evinced to confirm that
the electrical panels were locked with any deliberate intend to
interfere with production. The Court is satisfied that the
Company decision to dismiss the worker was to a large degree
influenced by the high degree of tension which existed in overall
relationships at the time.
The Court therefore recommends that the dismissal to date be
treated as a period of suspension and this worker be reinstated
without further delay. As an initial gesture towards the
re-establishment of mutual goodwill it also recommends that he be
paid for any time lost over and above that which was lost
generally due to industrial action.
