Dispute concerning the use of private operators.
Recommendation:
3. The Court following discussions with the parties recommends
the following procedure as a basis for a resolution of the dispute
in Bus Eireann.
1. That the extension of industrial action be deferred pending
consideration of the proposals.
2. That in the event of the proposals being accepted there will
be an immediate full resumption of normal working.
3. That a joint Monitoring Committee be established consisting of
an equal number of representatives of the trade unions and the
Company and chaired by an agreed independent chairperson.
The terms of reference of the Monitoring Committee shall be to
obtain and assess all such information as may be required to
enable the Committee to consider and to reach agreement as to
the manner in which Bus Eireann should cater for its customers
in the future.
The above assessment to be carried out over a period of four
week-ends commencing with week-end 25th October, 1991.
4. During this period in the event that the resources of Bus
Eireann, Dublin Bus and the hire in of buses without drivers
fail to meet the week-end demand the following procedure shall
apply; the Company shall consult with the Monitoring Committee
for the purpose of addressing the matter of augmenting the
service with a view to dealing with the spontaneous demand.

SUBJECT:
1. Dispute concerning the use of private operators.

2. The Court investigated the above dispute on 9th, 14th and 21st
October, 1991 and issued the following recommendation.
