SECTION 20(1) INDUSTRIAL RELATIONS ACT, 1969
PARTIES: DUBLIN WASTE DISPOSAL LIMITED
and
SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION
SUBJECT:
1. Dispute concerning Union recognition.
BACKGROUND:
2. In October, 1990 a number of workers joined the Union. In
the middle of 1991 the workers approached the Union to seek a
meeting on their behalf to discuss a number of issues.
3. The Union made a number of attempts through correspondence
to arrange a meeting with the Company. The Company refused to
meet with the Union.
4. The Union referred the issue of recognition to the Labour
Court for investigation and recommendation under Section 20 of
the Industrial Relations Act, 1969. A Court hearing was held on
28th May, 1992. The Union agreed to be bound by the Court's
recommendation. The Company did not attend nor was it
represented at the Court hearing.
UNION'S ARGUMENTS:
5. 1. The workers have been very patient in their dealings
with the Company. Despite the Company's refusal to meet
with them, they have not engaged in industrial action.
2. The Union is asking the Court to recommend that the
Company recognise the Union and enter into negotiations on
the various issues.
RECOMMENDATION:
Having heard the submission of the Union, the Court recommends
that the employer in this case recognise the Union and negotiate
with it in respect of its members in the employment.
