Recommendation:
The Court, having considered all of the issues raised by the
parties in their oral and written submission, recommends that the
appropriate machine rate should be applied in respect of the
operation of the 2-colour Litho machine (11%) for the period of
any such operation.

SUBJECT:
1. Payment of appropriate machine rate for 2-colour operation.
BACKGROUND:
2. 1. The dispute concerns a claim by the Union on behalf of 8
workers for an increase in a machine allowance from 8% to 11%
of basic pay to operate 2-colour machines (litho). The
workers concerned are presently paid at the following rate:

The Union wants the machine allowance increased to #20.85.
The Revenue Commissioners state that the 3% increase comes
under the term of the P.E.S.P. The Union rejects this. The
dispute was referred to the Labour Relations Commission. A
number of conciliation conferences were held but no agreement
was reached. On 10th September, 1993, the dispute was
referred to the Labour Court under Section 26(1) of the
Industrial Relations Act, 1990. A Labour Court hearing took
place on 2nd November, 1993.
UNION'S ARGUMENTS:
3. 1. There is a Registered Agreement between the Revenue
Commissioners and the Irish Printing Federation (details
supplied) regarding the rate of pay for a 2-colour litho
machine.
2. The attraction allowance and the productivity allowance
referred to by the Revenue Commissioners below are separate
issues to the 2-colour operator claim. These allowances were
negotiated with the Revenue Commissioners and have nothing to
do with the machine allowance.
REVENUE COMMISSIONERS' ARGUMENTS:
4. 1. The workers concerned are currently being paid #248.91
per week, considerably more than the standard rate of #210.41
for a 2-colour machine operator. This is because of an
in-house agreement which gives the workers an attraction
allowance of #11.90 and a productivity allowance of #32.06
per week.
2. The Union's claim for a 3% increase comes under clause 3
of the P.E.S.P. The Union cannot make a second separate
claim for a 3% increase for a machine allowance.
3. The Minister for Finance stated that there would be no
special pay increases for public servants in the 1993 budget.
There is no provision in the vote of the Revenue
Commissioners for pay increases for the workers concerned.
The Union's claim can only be dealt with within the terms of
the P.E.S.P.
RECOMMENDATION:
The Court, having considered all of the issues raised by the
parties in their oral and written submission, recommends that the
appropriate machine rate should be applied in respect of the
operation of the 2-colour Litho machine (11%) for the period of
any such operation.
