Having considered the Union submission the Court recommends that
the Company recognise the Union in respect of its members in the
business and affords the Union the necessary representational
facilities.

INDUSTRIAL RELATIONS ACT, 1969
PARTIES: MARROW MEATS LIMITED
and
SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION
SUBJECT:
1. Union recognition.
BACKGROUND:
2. In July, 1993, ten workers employed by the Company joined the
Union. On 30th July, 1993 and 18th August, 1993 the Union wrote
to management requesting a meeting to discuss rates of pay and
conditions of employment on behalf of the workers. The Company
did not reply to the Union's letters. The Union referred the
matter to the Labour Relations Commission. In a letter to the
Commission dated 20th September, 1993, the Company stated that
they did not recognise the Union.
3. The Union referred the matter to the Labour Court on 1st
October, 1993 under Section 20(1) of the Industrial Relations Act,
1969 and agreed to be bound by the Court's Recommendation. The
Court investigated the matter in Limerick on 18th November, 1993.
Prior to the Court hearing the Company informed the Court that it
would not be represented at the hearing.
UNION'S ARGUMENTS:
4. 1. A number of workers have sought the assistance of the
Union in relation to working conditions and industrial
relations in the plant. It would be in the best
interests of both the Company and the Union to have a
formal agreement in place.
2. The Union requests the Court to make a recommendation
that, in the interests of good staff relations, the
Union be granted recognition to enable it represent the
workers concerned in accordance with normal procedures
and the constitution of the Irish Congress of Trade
Unions.
RECOMMENDATION:
