Recommendation:
The Court having considered all of the aspects of this issue as
outlined by the parties in their oral and written submissions
consider the complainant's rate of pay should be reduced as
proposed by the Company and he should be paid a sum of #3,500 in
full and final settlement of the dispute.

PARTIES: AUTOZERO LIMITED
(REPRESENTED BY THE IRISH BUSINESS AND EMPLOYERS CONFEDERATION)
AND
SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION
SUBJECT:
1. A dispute concerning the rate of pay for a worker.
BACKGROUND:
2. 1. The matter was referred to the Labour Relations
Commission on the 9th January, 1992. A conciliation
conference was held on the 2nd March, 1992 but agreement
could not be reached. The dispute was referred by the Labour
Relations Commission to the Labour Court on the 18th March,
1992. The Labour Court investigated the matter on the 7th
April, 1992 and part of its recommendation issued on the 4th
June, 1992 stated:
"In the event that agreement has not been reached within
a period of one month from the date of this
recommendation the Court will review the outcome of the
discussions and make a recommendation."
2. Agreement could not be reached on this issue and on the
27th November, 1992 the Company, with the agreement of the
Union, referred it back to the Court for recommendation. The
Court investigated the matter on the 11th January, 1993.
RECOMMENDATION:
The Court having considered all of the aspects of this issue as
outlined by the parties in their oral and written submissions
consider the complainant's rate of pay should be reduced as
proposed by the Company and he should be paid a sum of #3,500 in
full and final settlement of the dispute.
