Recommendation:
4. It is a matter of concern to the Court that the employer in
the case did not deem it appropriate to attend the Court hearing
on this issue. Having considered the Union's submission, the
Court recommends that the employer acknowledges the right of the
hotel employees to be members of the Union and affords the Union
the right and opportunity to negotiate with the employer on their
behalf on matters of pay and conditions of employment.

SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION
SUBJECT:
1. Union recognition.
BACKCGROUND:
2. 1. A number of the Company's staff joined the Union in
September, 1992. The Union requested a meeting with the
Company to discuss wages and conditions but the Company
refused.
2. The matter was referred to the Labour Court under
Section 20(1) of the Industrial Relations Act, 1946 and the
Court investigated the issue on the 19th May, 1993. The
Company did not attend and was not represented at the hearing.
UNION'S ARGUMENTS:
3. 1. The Union is the designated trade union for hotel and
catering workers in this country.
2. It is the constitutional right of Irish workers to
belong to a Union.
RECOMMENDATION:
4. It is a matter of concern to the Court that the employer in
the case did not deem it appropriate to attend the Court hearing
on this issue. Having considered the Union's submission, the
Court recommends that the employer acknowledges the right of the
hotel employees to be members of the Union and affords the Union
