Three claims for a pay increase.
Recommendation:
5. Having considered the submissions of the parties and the oral
evidence presented at the hearing the Court recommends the
following salary adjustments in place of the Credit Union's offer.
MANAGER/FINANCIAL CONTROLLER:
Salary to be increased to #24,200 with effect from 1/12/93 -
Programme for Competitivness and Work terms to apply to this
salary at the appropriate dates.
FINANCE OFFICER:
Salary to be increased by #1,000 with effect from 1/12/93 -
Programme for Competitivness and Work terms to apply to this
salary at the appropriate dates.
ADMINISTRATION OFFICER:
An ex-gratia payment of #500 to be made to this claimant in full
and final settlement of her claim in respect of arrears.
The Court notes that settlement terms in respect of salary scales
of part-time staff have been agreed at Labour Relations Commission
and will be applied to the claimant in due course.

THREE WORKERS

SUBJECT:
1. Three claims for a pay increase.
BACKGROUND:
2. Claim A. The worker commenced employment with the Company in
June, 1982 on a salary of #10,000 per annum. His present salary
is #22,188 p.a. The Union is seeking to increase his salary to
#25,937.50 p.a. The Company offered to increase his salary to
#25,000 p.a. by 1st January, 1996.
3. Claim B. The worker commenced employment with the Company in
June, 1989, on a salary of #12,000 per annum. In January, 1993
the Union sought to increase her salary to #18,000 p.a. Her
current rate of salary is #13,800 p.a. The Company offered to
increase her salary to #16,000 p.a. by 1st January, 1996.
4. Claim C. The worker commenced employment with the Company in
1979. In June, 1986 she reverted to part-time work (13 hours per
week). Her part-time rate equated to #3.85 per hour. Her present
part-time rate is #4.15 per hour. The Union is seeking a
full-time rate of #6.99 per hour plus retrospection. The Company
offered #200 in settlement of the claim.
5. The dispute was referred to the Labour Relations Commission
and a conciliation conference took place on 1st September, 1993.
No agreement was reached and the dispute was referred to the
Labour Court under Section 26(1) of the Industrial Relations Act,
1990 on 4th May, 1994. A Labour Court hearing took place on 21st
June, 1994.
UNION'S ARGUMENTS:
CLAIM A.
3. 1. The worker's position of Manager/Financial Controller is
extremely important. The Company is the 17th largest Credit
Union in the country in terms of savings. The worker
introduced a number of changes and additional services to the
Company which have resulted in considerable savings for the
Company. He has attended a number of learning courses which
enable him to present seminars on behalf of the Company. His
salary does not compare favourably with other Credit Union
managers in the area.
CLAIM B.
2. The worker, who acts as Finance Officer with the
Company, fulfils a wide range of functions (details supplied
to the Court) She is responsible for the Company's finances.
Her role is comparable to that of Senior Finance Officer in
outside employment.
CLAIM C.
3. The worker's rate was #4.07 per hour in April, 1988.
She received no further increase until April, 1993 when her
rate was improved to #4.15 per hour. The worker has been with
the Company for fifteen years (eight years part-time). She
performs the same duties as other clerical/administration
staff in the Company. She deserves the full-time rate of
#6.99 per hour.
COMPANY'S ARGUMENTS:
CLAIM A
4. 1. The worker was placed on an incremental scale on joining
the Company in 1982. Since then he has received all increases
due under the various National Wage Agreements. It was felt
that the worker needed to improve some aspects of his
managerial function if a special pay increase is to be
granted. The Company offered to pay for any special courses
needed.
CLAIM B
2. Since the worker joined the Company as Finance Officer
in 1989 all National Wage Agreements have been paid. The
Company has offered to upgrade her wage to at least #16,000
p.a. by 1st January, 1996.
CLAIM C
3. All part-time workers with the Company are on the same
rate of pay. At the conciliation conference the Company
increased its ex-gratia offer to the worker from #200 to #300.
