Time Limit.
Recommendation:
The Court is satisfied that the claimant had a seniority list
available to her, and that she was aware of the manner in which,
because of her job-sharing, the Revenue Commissioners were
calculating her service for the purposes of seniority.
The claimant was further aware of the promotions which were taking
place in her local office.
The Court finds that in all probability the claimant was aware of
the large number of promotions made to the Dublin Office and that
many of these would have been junior to her.
Given all of the above the Court is not satisfied that reasonable
cause has been shown as to why the claim was not lodged within the
statutory time limit.

BACKGROUND:
2. The Labour Court investigated the above matter on the 4th
October, 1994 under Section 19(5) of the Employment Equality
Act, 1977. The following is the Court's decision.
DECISION:
The Court is satisfied that the claimant had a seniority list
available to her, and that she was aware of the manner in which,
because of her job-sharing, the Revenue Commissioners were
calculating her service for the purposes of seniority.
The claimant was further aware of the promotions which were taking
place in her local office.
