SUBJECT:
1 Union Recognition.
BACKGROUND:
2. In June, 1994, 45 workers employed by the Company joined the
Union. On 29th June, 1994 and 12th July, 1994 the Union
wrote to management of the Company requesting a meeting to
discuss the rates of pay and conditions of employment of the
workers concerned. The Company did not reply to the Union's
letters. In August, 1994, the Company declined an invitation
to attend a conciliation conference at the Labour Relations
Commission.
The Union referred the dispute to the Labour Court on 15th
August, 1994 under Section 20(1) of the Industrial Relations
Act, 1969 and agreed to be bound by the Court's
recommendation. A Labour Court hearing took place in
Donegal on 15th September, 1994. Prior to the Court hearing
the Company informed the Court that it would not be
represented at the hearing.
UNION'S ARGUMENTS:
3. 1. The Union requests the Court to make a recommendation
that in the interest of good staff relations, the Union
be granted recognition to enable it to represent the
workers concerned in accordance with normal procedures
and the constitution of the Irish Congress of Trade
Unions.
RECOMMENDATION:
The Court notes that the Company informed the Court that it would
not attend the hearing or make a statement.
The Court having considered the submission from the Union
recommends that the Company recognise the Union and accept the
Union's right to represent its members in the employment of the
Company.
