PARTIES:
GOLD STAR MEATS LIMITED
AND
MARINE PORT AND GENERAL WORKERS' UNION
SUBJECT:
Negotiation rights.
BACKGROUND:
In August, 1995, a number of workers employed by the Company
approached the Union with a view to taking out membership.
The Union wrote to the Company, informing it that 9 workers
had been taken into membership. The Company did not reply.
The Union wrote again on a number of occasions but still
received no reply. A further 9 workers joined the Union by
October, 1995.
The Union referred the dispute to the Labour Court on 11th
October, 1995, in accordance with Section 20(1), Industrial
Relations Act, 1969. A Labour Court hearing took place on
27th November, 1995. The Company did not attend the hearing
or forward a submission.
UNION'S ARGUMENTS:
1. The wages and conditions of the workers are extremely bad,
and the Union should be given the opportunity to represent
them. It is a worker's right to join a union under the
Constitution.
2. A number of Union members are in danger of losing their jobs
because of recent events. The Managing Director of the
Company is a member of Irish Business and Economic
Confederation (IBEC) but has refused to allow the workers to
join a union.
RECOMMENDATION:
The Company did not attend the hearing or input a submission.
The Court, having considered the Union's submission, recommends
that the Company recognise the Union's right to represent and
negotiate on behalf of those employees who are members of the
Union.
