Recommendation:
From the evidence provided to the court it is clear the Union have
in membership a significant number of the employees in the
Company.
Accordingly the Court recommends the Company recognise the Union
on behalf of its members.

SUBJECT:
1. Union recognition.
BACKGROUND:
2. The Company supplies the graphic arts and printing industries
and employs 50 workers. In April, 1995 a number of workers
joined the Union. Subsequently the Union wrote to the
Company requesting a meeting to establish recognition and
negotiate a procedural agreement. The Company did not
respond in a favourable way. The Union sought to refer the
dispute to the Labour Relations Commission but the Company
was unwilling to attend a conciliation conference. On the
13th July, 1995, the Union referred the dispute to the Labour
Court under Section 20(1) of the Industrial Relations Act,
1969 and agreed to be bound by the Court's recommendation. A
Court hearing was held on the 1st September, 1995. The
Company declined an invitation to attend the hearing.
UNION'S ARGUMENTS:
3. 1. A number of workers in the employment have exercised
their constitutional rights and joined the Union
(details supplied to the Court). It is reasonable and
in the best interest of good industrial relations that
the Company should recognise the Union and afford it the
the facility to negotiate on behalf of these workers.
2. The Court has recommended in favour of Union recognition
in many similar cases.
RECOMMENDATION:
From the evidence provided to the court it is clear the Union have
in membership a significant number of the employees in the
Company.
Accordingly the Court recommends the Company recognise the Union
on behalf of its members.
