Breach of the Construction Industry Registered Employment Agreement on Pensions, Assurance and Sick Pay.
Recommendation:
The Court was informed that the Company was no longer trading and,
therefore, an inspection of the Company records is not practical.
However, the Employer acknowledged that he was aware of his
obligations from April 1994. The Court, therefore, orders that
the Employer pay all arrears of contribution from April 1994 to
the date of his cessation of business in September, 1994, in
accordance with the Pensions, Assurance and Sick Pay provisions of
the Registered Agreement.

SUBJECT:
Breach of the Construction Industry Registered Employment
Agreement on Pensions, Assurance and Sick Pay.
BACKGROUND:
A letter was sent to Mr. Michael Cleere on 7th November, 1994
(per registered post) informing him that a complaint had been
received regarding an alleged breach of the Agreement by him.
A Labour Court hearing took place on 19th September, 1995, in
Portlaoise.
ORDER:
The Court was informed that the Company was no longer trading and,
therefore, an inspection of the Company records is not practical.
However, the Employer acknowledged that he was aware of his
obligations from April 1994. The Court, therefore, orders that
the Employer pay all arrears of contribution from April 1994 to
the date of his cessation of business in September, 1994, in
accordance with the Pensions, Assurance and Sick Pay provisions of
the Registered Agreement.
