Recommendation:
The Corporation indicated that the negotiations currently taking
place would be concluded by the end of October 1995 and would
include a sick pay scheme for part-time cleaners.
In the event of this not being the case, the Court recommends that
a sick pay scheme for part-time cleaners be implemented from 1st
January, 1996.
All issues in relation to implementation and structure of the
scheme to be finalised before 1st January, 1996.

SUBJECT:
Introduction of a sick leave scheme for part-time office
cleaners.
BACKGROUND:
The claim is on behalf of 39 three-quarter time cleaners to
be included in a paid sick leave scheme which applies to all
other non-officer grades in the Corporation.
The claim was first served on 21st September, 1994. In a
letter to IMPACT on 30th March, 1995, the Corporation stated
that it would be favourably disposed to the cleaners being
included in the sick leave scheme. It also stated that, as a
review of sick pay schemes applying to non-officers was being
undertaken by the Local Government Staff Negotiations Board
(LGSNB), it wished to consider the matter. A restructuring
of the general operative work force was imminent and the
Corporation wanted this issue concluded first, as it could
affect the dispute.
The dispute was referred by the Unions to the Labour Court on
20th July, 1995, in accordance with Section 20(1), Industrial
Relations Act, 1969. A Labour Court hearing took place on
13th September, 1995.
UNION'S ARGUMENTS:
1. In its letter of 30th March, 1995, the Corporation stated
that it was in favour of the cleaners concerned being
included in the sick pay scheme. Final discussions on the
general operative workforce are unlikely to be concluded
until the end of 1995. There is no justification in the
delay, as the claim was originally served in September, 1994.
2. The 39 cleaners represent only 1.44% of the total non-officer
workforce. The cost of including them in a sick pay scheme
would be very small. There would be no repercussive effect.
CORPORATION'S ARGUMENTS:
1. The Corporation has agreed to implement a sick pay scheme for
the cleaners but wishes to do so in an orderly and structured
fashion. The Unions were informed, at a local meeting in
February, 1995, that the Corporation was awaiting the outcome
of the restructuring of the general operative workforce and
the review by the LGSNB. They expressed no opposition to
this course of action at the time.
2. The dispute should be dealt with in terms of the ongoing
restructuring talks. In a letter dated 25th February, 1995,
the Unions stated in relation to the restructuring talks,
that "there are a number of issues which we wish to place on
the Agenda...... an improved sick leave scheme".
RECOMMENDATION:
The Corporation indicated that the negotiations currently taking
place would be concluded by the end of October 1995 and would
include a sick pay scheme for part-time cleaners.
