SECTION 20(1), INDUSTRIAL RELATIONS ACT, 1969
PARTIES: MICHAEL GALVIN AND SON LIMITED
and
SALES MARKETING AND ADMINISTRATIVE UNION OF IRELAND
SUBJECT:
1. Union recognition and negotiating rights.
BACKGROUND:
2. 1. The Union is in dispute with the Company over recognition
and negotiating rights on behalf of its members employed
as sales representatives.
2. The Company refused to meet with the Union to try and
resolve the dispute and also refused the help of the
Conciliation Service of the Labour Relations Commission.
3. The Union referred the dispute to the Labour Court under
Section 20(1) of the Industrial Relations Act, 1969 and
agreed to be bound by the Court's recommendation. The
Court investigated the dispute on the 28th March, 1996.
The Company indicated that it would not be attending the
Court hearing.
UNION'S ARGUMENTS:
3. 1. Other employees in the Company have trade union
representation.
2. The Company is a member of an employers' trade union.
3. All employees have the right to be represented by a trade
union.
RECOMMENDATION:
4. The Court notes the Company indicated that they would not
attend the hearing.
On the basis of the submission from the Union the Court recommends
that the Company recognise the Union's right to represent the
employees of the Company it has in membership.
