1. Rehearing arising from LCR15190.
BACKGROUND:
2. The Court investigated the above on Monday 12th August, 1996. The following is the Court's recommendation.
RECOMMENDATION:
Subsequent to the issue of LCR15190, the Union requested a further hearing on the basis that information given to the Court had proved to be inaccurate and misleading.
The Court accordingly held a further hearing on 12th August, 1996.
Having considered the submissions from the parties, the Court is satisfied that the information referred to was incorrect. The Court accepts that it was not the Company's intention to mislead the Court and the inaccurate information was given on a genuine if incorrect basis.
The Court accordingly re-examined the details of the original hearing and has concluded that in making recommendation LCR15190 it was influenced to some extent by this incorrect information.
In the light of the current and revised circumstances the Court considers the most appropriate recommendation it should make is to remedy the situation from the Union's point of view as early as possible.
The Court accordingly recommends that from 1st September, 1996 the L1011 be crewed by 10 Aer Lingus Cabin Crew members.
