Recommendation:
5. Having considered the submissions from the parties the Court
recommends as follows:-
Full time Employees - Salary scale of £9,000 x £1,000 (4) - £13,000
x £500 - £13,500
The present incumbent to enter the scale at point £11,000.
Part-time employees to be paid at the appropriate proportionate
rate.
The Court is satisfied that the question of weekly hours was not
properly before the Court so the existing weekly hours apply to the
above.

PARTIES: TRINITY CREDIT UNION
and
SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION
SUBJECT:
1. Wage claim.
BACKGROUND:
2. 1. The Trinity Credit Union is situated in Donaghmede
Shopping Centre, Dublin. It employs a manager and 3
clerical employees. (1 full time and 2 part-time). The
workers joined the union in 1995. The dispute only
involves the clerical staff.
2. It has an active membership of approximately 4,300.
Trinity Credit Union has proposed a revised pay structure
of £10,430 rising to £11,812 at the maximum for the
employees concerned but this has been rejected by the
Union. The Union has proposed a salary scale of £9,000
rising to £14,000 at the maximum. Trinity Credit Union
rejected the Union's proposed new pay structure.
3. As no agreement could be reached between the parties the
dispute was referred to the Labour Relations Commission
and a conciliation conference was held on 4th September,
1995 and 24th October, 1995.
4. Agreement could not be reached at conciliation and the
dispute was referred to the Labour Court on 6th November,
1995 under Section 26(1) of the Industrial Relations Act,
1990. The Court investigated the dispute on the 18th
January, 1996 (earliest date suitable to both sides).
UNION'S ARGUMENTS:
3. 1. All Credit Unions should pay the same rate of pay
regardless of membership. Staff in each Credit Union do
work of equal value. Many other Credit Unions have
higher scales of pay than Trinity Credit Union.
2. The Credit Union movement has developed significantly
over the years with professional standards expected in
all areas of administration.
3. Staff must now reach competency in personal skills,
computerisation, accounting and many other facets of
office work.
4. Trinity Credit Union operate a 38.5 hour working week
which is 3 hours above the average for clerical
employment.
COMPANY'S ARGUMENTS:
4. 1. Trinity Credit Union has an active membership of 4,300.
It is restricted by regulation from recruiting
shareholders outside its own area. This affects the
amount of capital available to it.
2. The profits of the Credit Union are paid back to the
shareholders each year in the form of dividends.
3. Trinity Credit Union has paid all awards under the
various National Pay Agreements. It made an offer at
conciliation to improve the salary scales for staff which
was fair and reasonable.
4. Oldcastle Credit Union and Driminagh Credit Union are
similar to Trinity Credit Union in terms of the number of
shareholders. The clerical staff in these Credit Unions
are paid a maximum £10,920 and £11,270 respectively.
RECOMMENDATION:
