This dispute concerns a claim by Mr. Martin Smyth that, on 23rd April, 1993 the Eastern Health Board discriminated against him in terms of Section 2(a) and Section 2(c) of the Employment Equality Act, 1977 and in contravention of Section 3 of that Act by refusing him time off under the 39 Hour Agreement despite the fact that he had given adequate notice requesting the time off.
