1. Union recognition.
BACKGROUND:
2. The employer operates 3 cr�ches and employs 16 workers. The claim for recognition is on behalf of 15 workers who are members of the Union. Having approached the employer, unsuccessfully, concerning the matter of recognition, the Union referred the issue to the Labour Court, on the 7th of February, 1997, in accordance with Section 20(1) of the Industrial Relations Act, 1969. The Court investigated the matter on the 26th of March, 1997. The employer side declined to attend at the Court hearing.
UNION'S ARGUMENTS:
3. 1. Recognition is being sought on behalf of 15 of the 16 employees. The Union has approached the employer, directly, on numerous occasions and also through the Labour Relations Commission, to no avail.
2. The Union wishes to negotiate with the employer on the issues of wages and working conditions.
RECOMMENDATION:
The Court, having considered the views put forward by the Union and, noting that the vast majority of the staff are members of the Union, recommends that the right of the Union to represent its members be recognised.
