1. Appeal by Mr. Murphy against the Equality Officer's Recommendation EE6/1997 concerning an allegation that the City of Waterford VEC discriminated against him contrary to the provisions of the Employment Equality Act, 1977.
BACKGROUND:
2. The claimant applied for the post of Clerical Officer (Grade III) with Waterford VEC. He was interviewed for the position on the 22nd of January, 1996 and was subsequently notified that he was unsuccessful in his application. On the 28th of June, 1996 the claimant referred a complaint to the Labour Court that Waterford VEC discriminated against him in terms of Section 2 of the 1977 Act. On 3rd July, 1996 the Court referred the matter to an Equality Officer for investigation and recommendation.
The Equality Officer in her recommendation which was issued on the 16th of April, 1997, found that Waterford VEC did not discriminate against the claimant. On the 19th of May, 1997 the claimant appealed the Equality Officer's recommendation to the Labour Court. The Court arranged to hear the appeal in Waterford on the 8th of October, 1997. Both parties made written submissions (details supplied to the Court). The claimant did not attend the hearing.
DETERMINATION:
The complainant did not put in an appearance and did not advise the Court of any difficulties regarding attendance.
The Court, having been satisfied that notice was properly given to the complainant of the date, time and venue of the hearing strikes out this appeal.
