1. Complaint that the Rights Commissioner's Decision WT149/98 has not been implemented.
BACKGROUND:
2. A Labour Court hearing took place on the 21st September, 1998.
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 by Michael Moriarty of Flat 5, 95 Marian Road, South Circular Road, Dublin 8, that his employer, The Marlborough Group, Tara House, Tara Street, Dublin, failed to implement a decision of a Rights Commissioner No. WT149/98/JH dated 23rd July, 1998,
And the said decision not having been carried out by the employer,
And no appeal having been brought against the said decision within the time limited for such appeal,
The Court hereby determines that the said employer pay to the said employee holiday pay in accordance with the decision of the Rights Commissioner.
