1. Complaint that Rights Commissioner's Decision WT 251/99/CW has not been implemented.
BACKGROUND:
2. The Labour Court investigated the above complaint on the 11th of November, 1999. The following is the Court's determination.
DETERMINATION:
A complaint having been received under Section 28 (8) of the Organisation of Working Time Act, 1997, by Seamus Conneely, 103 Kincora Road, Clontarf, Dublin 3, that his employer, Ms. Imelda Orange, Bushfield Guest House, 57 Philipsburgh Avenue, Fairview, Dublin 3, failed to implement a decision of a Rights Commissioner No. WT251/99/CW dated 1st of September, 1999, and the said decision not having been appealed by the employer.
The Court heard the case on the 11th of November, 1999. The employer furnished the Court with a written statement to the effect that the decision had been complied with.
The Court is satisfied from the information presented by both sides that the decision of the Rights Commissioner has been complied with and that the employer has no further case to answer.
The Court therefore dismisses the complaint.
The Court so decides.
