1. Hearing arising from Labour Court Recommendation No. LCR16116.
BACKGROUND:
2. In December, 1998, the Union referred a dispute to the Labour Court in accordance with Section 20(1) of the Industrial Relations Act, 1969. The dispute concerned the refusal of the Company to recognise the Union for the purpose of representing one worker. A Labour Court hearing took place on the 3rd of March, 1999 and Labour Court Recommendation No. LCR16116 issued on the 22nd of March, 1999.
As recommended, the parties met to discuss the worker's outstanding issues. A meeting was held on the 30th of April, 1999, at which there was a disagreement concerning the wording and/or interpretation of the Labour Court Recommendation. On the 4th of May, 1999, the Union wrote to the Labour Court seeking clarification of the Recommendation. Both parties attended a further Labour Court hearing on the 8th of December, 1999.
RECOMMENDATION:
Labour Court Recommendation No. LCR16116 recorded an agreement reached between the parties at the hearing for the purpose of addressing and resolving a number of specific issues in relation to one individual.
That agreement amounted to an acknowledgement by the Company that the Union would act for and represent the individual in relation to the specific issues raised.
The Court would urge the parties to proceed to deal with these issues without further delay on the basis set out in LCR16116, as now clarified.
