FULL RECOMMENDATION
SECTION 19(5), EMPLOYMENT EQUALITY ACT, 1977 PARTIES : CORK COUNTY V.E.C. - AND - MS. KATHLEEN O'BRIEN DIVISION : Chairman: Mr Duffy Employer Member: Mr McHenry Worker Member: Mr O'Neill |
1. Time Limit.
BACKGROUND:
2. The Court investigated the above matter, in Cork, on the 2nd November, 1999. The following is the Court's decision.
DECISION:
The Court notes that the employer in this case is not opposing the worker's application for an extension of time in which to bring her claim.
Notwithstanding the attitude taken by the V.E.C., the Court must be satisfied that reasonable cause exists for the failure to bring the complaint within the statutory time-limit.
Having reviewed the evidence in this case, the Court is satisfied that reasonable cause has been shown. Accordingly, the Court directs that the applicant's complaint be referred to an Equality Officer for investigation and recommendation.
Signed on behalf of the Labour Court
