1. Alleged non-implementation of Rights Commissioner's Decision WT144/99/CW.
BACKGROUND:
2. The Labour Court investigated the above complaint on the 28th of March, 2000. The following is the Court's Determination:-
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, by Catherine Osgood, Grange, Granlahan, Co. Roscommon that her former employer Mr. John Conroy, a Ward of Court, represented by T. Dillon-Leetch and Sons, Solicitors, Ballyhaunis, Co. Mayo failed to implement a Decision of a Rights Commissioner No. WT144/99/CW dated the 8th of December, 1999,
And the said Decision not having been carried out by the employer, and no appeal having been brought against the Decision within the time limited for such appeal.
The Court hereby determines that the said employer pay to the said employee the sum of £2622 (£1622 entitlement and £1000 compensation) net in respect of holiday pay and public holiday pay, in accordance with the Decision of the Rights Commissioner.
The Court so determines.
