1. Complaint that Rights Commissioner's Decision that WT786/00/JH has not been implemented.
BACKGROUND:
2. An application has been made by the employee that WT786/00/JH has not been implemented by the employer.
DETERMINATION:
A complaint, under Section 28(8) of the Organisation of Working Time Act, 1997, having been received from Mr. John Burns, 82, Cherrywood, Loughlinstown, Co. Dublin, that his former employer, Rochestown Lodge Hotel, Rochestown Ave., Killiney, Co. Dublin, failed to implement Rights Commissioner's Decision WT786/00/JH, dated the 11th May, 2000,
And, the said Decision not having been carried out by the employer,
And, no appeal having been brought against the said Decision within the time limited for such appeal,
The Court, hereby, determines that the said employer pay the said employee the sum of £379 nett, in respect of holiday pay, in accordance with the Decision of the Rights Commissioner.
