1. Complaint that Rights Commissioner's Decision WT177/99/GF has not been implemented.
BACKGROUND:
2. A Labour Court hearing took place on the 28th of January, 2000.
DETERMINATION:
A complaint having been received under Section 28 (8) of the Organisation of Working Time Act, 1997, (the Act), by John Butler of 85 San Herblin Park,Kilcohen,Waterford, that his Employer, Toymaster, Ring Road, Waterford, failed to implement a Decision of a Rights Commissioner No. WT177/99/GF, dated 23rd of August, 1999.
The said Decision not having been implemented by the Employer, and no appeal having been brought against the said Decision within the time allowed, the Court, in accordance with its power under Section 28(8) of the Act, affirms the Decision of the Rights Commissioner and determines that the Employee shall be paid the sum of £150 holiday pay by the Employer in respect of his claim under the Organisation of Working Time Act, 1997.
The Court so determines.
