FULL RECOMMENDATION
INDUSTRIAL RELATIONS ACTS, 1946 TO 1990 SECTION 20(1), INDUSTRIAL RELATIONS ACT, 1969 PARTIES : PEGASUS PACKAGING SOLUTIONS (REPRESENTED BY BECKER TANSEY & COMPANY) - AND - A WORKER DIVISION : Chairman: Mr Flood Employer Member: Mr McHenry Worker Member: Mr. Somers |
1. Alleged unfair dismissal.
BACKGROUND:
2. The Company is located at Cookstown Industrial Estate. The worker was employed by the Company from the 6th of February, 1999. She claims she was unfairly dismissed on the 8th of December, 1999.
The worker referred a claim of unfair dismissal to the Labour Court in accordance with Section 20(1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court's recommendation. The Court investigated the dispute on the 27th of June, 2000.
The Company did not make a submission to the Court and did not attend the hearing.
WORKER'S ARGUMENTS:
3. 1. She was hard working and did overtime when requested at very short notice.
2. During her employment she was told by her employer that she was a good worker.
3. She was unfairly dismissed and no reason was given for the dismissal.
RECOMMENDATION:
The Employers indicated through their Solicitor that they would not be attending the Court hearing.
The Court, therefore, had only the information as presented by the claimant in relation to this case.
Having considered the written and verbal submissions presented, the Court is satisfied that the manner of her dismissal was unfair.
The Court recommends that the Employer pay the claimant £650 as compensation in full and final settlement of this case.
Signed on behalf of the Labour Court
Finbarr Flood
