1. Hearing arising from Labour Court Recommendation LCR16502
BACKGROUND:
2. The Labour Court held hearings on the 26th and 29th of June, 2000.
RECOMMENDATION:
The recent Court hearings arose in relation to clarification of LCR16502. The parties initially outlined to the Court on Monday the 26th of June, the detail of the discussions that had taken place following the issuing of the Recommendation.
It was clear to the Court, and accepted by the parties, that in an attempt to arrive at a solution to this dispute, the discussions had broadened beyond the issues covered in LCR 16502.
At meetings the Court held separately with the parties, both sides argued that the other side had failed to enter into meaningful discussion on possible ways to resolve the dispute. The Union also stated that it was unclear as to what was actually being offered by the Company.
The Court having considered all the information before it at that time, insisted that the parties enter into immediate intensive negotiations. These negotiations were to be completed by 11.30 am on 29th of June, when the Court would reconvene.
The Court met the parties on the 29th of June and was briefed by them on their respective positions. The Court noted that extensive discussions did place between the parties during the period between Monday the 26th of June and the resumption of the hearing on the 29th of June in accordance with its advice and would like fully to acknowledge the commitment of both parties over this period.
It is clear that a wide range of options were considered by the parties and that the negotiations could be taken no further. At the conclusion of the discussions, the Company tabled its final position.
The Court having considered carefully all the information before it, is of the view that the final Company offer should now be put to the employees for their consideration.
