1. Alleged constructive dismissal
BACKGROUND:
2. The worker is claiming constructive dismissal on the grounds of breach of verbal contract and non-payment of wages. The employer denies that any dismissal took place or that the worker is owed any money. He claims that the worker left his employment without giving verbal or written notice. He also claims that while he was employed, the worker was rarely punctual and showed no interest in the work.
The worker referred his case to the Labour Court on the 13th of December, 1999, in accordance with Section 20(1) of the Industrial Relations Act, 1969. A Labour Court hearing took place on the 23rd of February, 2000, in Carlow. The worker agreed to be bound by the Court's recommendation.
RECOMMENDATION:
The claimant failed to attend the Court hearing to present his case. In these circumstances, the Court does not recommend that his claims be conceded.
