1. Complaint that Rights Commissioners Decision WT481/99/JH has not been implemented.
BACKGROUND:
2. A Labour Court hearing took place on the 18th of April, 2000.
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, (the Act), by Paul Gilsenan of Drumlerry, Oldcastle, Co. Meath, that his former employer, Bator Ltd, having its registered office at 70 Amiens Street, Dublin 1, failed to implement a Decision of a Rights Commissioner No. WT481/99/JH, dated the 12th of January, 2000.
And the said Decision not having been carried out by the employer, and no appeal having been brought against the said Decision within the time limited for such an appeal.
The Court hereby determines that the said employer pay to the said employee the sum of £600 in respect of holiday pay, in accordance with the Decision of the Rights Commissioner.
The Court so determines.
