1. Alleged non-implementation of Rights Commissioner's Decision WT56/99/GF.
BACKGROUND:
2. A Labour Court hearing took place on the 18th of April, 2000.
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, (the Act), by Thomas McCormack of 66 Ginnell Terrace, Mullingar, Co. Westmeath, that his former employer, Alan Cusack, trading as Cusack Construction, having its registered office at Ballyfore, Edenderry, Co. Offaly, failed to implement a Decision of a Rights Commissioner No. WT56/99/GF, dated the 25th of February, 2000.
And the said Decision not having been carried out by the employer, and no appeal having been brought against the Decision within the time limited for such an appeal.
The Court hereby determines that the said employer pay to the said employee the sum of £724 in respect of holiday pay, in accordance with the Decision of the Rights Commissioner.
The Court so determines.
