1. Alleged non-implementation of Rights Commissioner's Decision MW3072/00/JH.
BACKGROUND:
2. A Labour Court hearing took place on the 10th of August, 2001.
DETERMINATION:
A complaint having been received under Section 31(1) of the National Minimum Wage Act, 2000, (the Act), by Anita Buckley of 26 Sean Browne Crescent, Enniscorthy, County Wexford, that her employer, Mary Kehoe, trading as The Flower Gallery, 23 Rafter Street, Enniscorthy, County Wexford, failed to implement a decision of a Rights Commissioner No. MW3072/00/JH, dated the 20th of December, 2000,
And the said decision not having been carried out by the employer,
And no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee £4.40 (5.59 Euro), in respect of every hour worked by her in the employment of the said employer with effect from the 20th of December, 2000, the date of the Rights Commissioner's Decision, and £1,030 (1,307.83 Euro), in respect of arrears of pay and compensation, to the date of the said Decision, in accordance with the decision of the Rights Commissioner.
Note not forming part of the determination:With effect from the 1st of July, 2001 the National Minimum Wage has increased to £4.70 (5.97 Euro) per hour.
