1. Alleged non-implementation of Rights Commissioner's Decision WT2374/00/CW.
BACKGROUND:
2. An application has been made by the employee that Decision No. WT 2374/00/CW has not been implemented by the Employer.
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 by Ali Saingay that his former employer, Shahid Sultan, Trading as Tandoori Nites, of 37 Finnes Wood, Finnstown, Lucan, Co. Dublin failed to implement a decision of a Rights Commissioner No. WT2374/00/CW, dated 10th November, 2000.
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee £360 in respect of holiday pay and a further £360 in compensation for other contraventions of the said Act in accordance with the decision of the Rights Commissioner.
