The dispute concerns a claim by the First Named Claimant and the Second Named Claimant (the Claimants) that on various dates between September, 1996 and April, 1998, the Board of Management and Principal of a named Secondary Boys School (the School) discriminated against them within the meaning of Section 2(a), (b), (c) and (d) of the Employment Equality Act, 1977 and in contravention of Section 3 of that Act. It is alleged that over a period of time, the Claimants were subjected to both verbal and physical harassment of a sexual nature by pupils at the School during the course of their teaching work and that the Claimants were penalised for having in good faith referred a complaint to the Labour Court under the provisions of the 1977 Act. The Employment Equality Agency, now the Equality Authority, separately referred a complaint to the Labour Court in accordance with Section 20 of the 1977 Act concerning alleged discriminatory treatment of female teaching staff at the School. As the three complaints concerned similar allegations the parties agreed that the complaints be investigated together by the Equality Officer. It is normal practice in cases of alleged sexual harassment not to name the parties in Equality Officer recommendations.
