1. Complaint that Rights Commissioner's decision has not been implemented.
BACKGROUND:
2. An application has been made by the employee that the Rights Commissioner's Decision WT3202/00/MR has not been implemented by the employer.
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act 1997 from Catherine Dunne, of 20 Norwood Park, Cobh, Co Cork, that her former employer, Mr Tom Coughlan, trading as Rush Brook Hotel, Cobh, Co Cork, failed to implement a decision of a Rights Commissioner No WT3202/00/MR dated 21st March 2001.
And the said decision not having been carried out by the employer and no appeal having been brought against the said decision within the time limit for such appeal.
The Court hereby determines that the said employer pay to the said employee £3,256 (4,134.27 euros) in respect of holiday pay and compensation in accordance with the decision of the Rights Commissioner.
