1. Alleged non-implementation of Rights Commissioner's Decision WT3181/00/CW.
BACKGROUND:
2. A Labour Court hearing took place on the 2nd of July, 2001. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, (The Act) by Michael Brennan, 53 Beneavin Park, Glasnevin, Dublin 11, that his former employer Cedar Inns Limited trading as Blakes Tavern, Blakestown Way, Blakestown, Clonsilla, Dublin 15 failed to implement a decision of a Rights Commissioner WT3181/00/CW dated 18th April, 2001, and the said decision not having been carried out by the employer and no appeal having been brought against the said decision within the time allowed for such an appeal,
The Court hereby determines that the said employer pay to the said employee the sum of £2000 (2539.48 Euros) in respect of holiday pay in accordance with the decision of the Rights Commissioner. The Court so determines.
