1. Complaint that Rights Commissioner's Decision No. WT3199/00/MR has not been implemented.
BACKGROUND:
2. An application has been made by the employee that Decision No.WT 3199/00/MR has not been implemented by the employer.
DETERMINATION:
A complaint having been received under Section 28(8) of the organisation of Working Time Act, 1997 (the Act) by Ms. Caroline O'Connell, Knocknacullen, Belgooly, Co. Cork that her former Employer Joseph Byrne trading as Joseph's Hair Salon Cork failed to implement a decision of a Rights Commissioner WT3199/00/MR dated 9th March, 2001.
And the said Decision not having been carried out by the Employer, and no appeal having been brought against the said Decision within the time limited for such an appeal.
The Court hereby determines that the said Employer pay to the said Employee the sum of £395 (501.55 Euros) in respect of holiday pay and compensation in accordance with the Decision of the Rights Commissioner.
The Court so determines.
